1. Who we are
Webstatic is a service for creating, delivering and hosting static presentation websites. The service is operated by DARKMOON LABS S.R.L., with identification details 48340945, referred to below as "Webstatic", "we" or "the provider".

2. Who the service is for
Webstatic services are intended mainly for professionals, companies, sole traders, organisations and people who need a static presentation website. If an individual acts as a consumer, their mandatory consumer rights are not limited by these terms.
3. What we provide
Depending on the selected package and agreed offer, Webstatic may provide services such as static website design and implementation, content structuring, AI-assisted text or visual ideas refined manually, image integration, mobile optimisation, basic SEO setup, Cloudflare/SSL configuration, publishing and static hosting.
Webstatic websites are normally static websites built with HTML, CSS and JavaScript. They do not include an admin panel, databases, user accounts, payment processing, online store functionality or complex app features unless separately agreed in writing.
4. Offers, packages and pricing
Prices shown on the website are indicative for standard packages and may vary depending on complexity, content volume, number of sections, languages, functionality, available materials and delivery timeline.
The specific offer, order, invoice, contract or written confirmation agreed with the client prevails over general information on the website.
5. Domain and client materials
The domain is purchased and owned by the client, unless otherwise agreed in writing. We may guide the client through the purchase and configuration process, but the client is responsible for maintaining control over the domain, renewing it and keeping ownership details accurate.
The client is responsible for providing accurate information and ensuring that they have the right to use all texts, images, logos, trademarks, business details and other materials sent to Webstatic. The client is responsible for claims or damages caused by materials they were not entitled to use.
6. Text, images and AI
We may use AI tools for ideas, structure, text, images or visual elements. Generated content is manually refined, but the client must review it before approval, especially business details, prices, promises, legal wording, services offered and claims about their own business.
We do not guarantee that AI-assisted content is appropriate for regulated industries such as medical, financial, legal, insurance, health, supplements, gambling or other sensitive sectors. In such cases, the client should obtain specialist validation.
7. Workflow and final approval
The typical workflow includes initial discussion, structure planning, material collection, website creation, review, final approval, invoicing and publishing. After final approval, we issue the invoice. Final publication takes place after payment confirmation, unless otherwise agreed in writing.
Final approval means that the client confirms the design, texts, prices, contact details, images and essential information are correct for publication.
8. Included changes and additional changes
Packages may include 7 days of small changes after delivery, as described in the selected package or offer. Included changes refer to reasonable adjustments to existing content, corrections, minor text changes, image changes or visual ordering.
Complete redesigns, major structural changes, new functionality, extra pages, translations, significant new materials, changes caused by incorrect initial information or requests after the included period are not included for free and may be charged separately.
9. Included static hosting
Static hosting is included for an unlimited period as long as the Webstatic service remains active and the website complies with the terms of use. This is not an unconditional promise of free hosting forever, but a facility offered for eligible static websites within reasonable usage limits.
Included hosting applies to normal static presentation websites without backend systems, databases, public file uploads, custom applications, streaming, massive storage, illegal content, spam, phishing, malware, scraping, abusive campaigns or abnormal traffic that affects the infrastructure.
We reserve the right to suspend, limit or discontinue hosting if a website breaches the law, third-party rights, these terms, technical provider requirements, or creates security, reputational, financial or operational risk.
If the service changes significantly in the future or we can no longer provide hosting under the same conditions, we will try to notify the client reasonably and, upon request, provide a copy of the website files together with migration instructions.
10. Webstatic footer credit
Start and Business packages may include a discreet footer credit such as "Website created by Webstatic". Removing the credit may be included in higher packages or offered as a paid option, depending on the agreed offer.
11. Security, uptime and maintenance
Static websites generally have a smaller attack surface than websites with admin panels, databases and plugins, but no digital system has zero risk. We do not guarantee that a website, domain, DNS, CDN, email or third-party service will never experience downtime, errors, attacks, blocks or technical issues.
Included hosting is not an SLA, does not guarantee 100% uptime and does not include unlimited interventions, permanent support, general IT administration, securing the client’s devices, managing external accounts or support for third-party services unless contracted separately.
12. Third-party services
The website may rely on third-party services such as domain registrars, Cloudflare, hosting providers, email providers, WhatsApp, Google Analytics, Google Search Console, Google Maps or other tools. These services have their own terms, policies and limitations, and Webstatic is not responsible for their changes, costs, unavailability or decisions.
13. Limitation of liability
To the extent permitted by law, Webstatic is not liable for indirect losses, loss of profit, loss of opportunity, business interruption, data loss, penalties applied to the client due to information provided by the client or consequences caused by third-party services.
To the extent permitted by law, Webstatic’s total liability for a project is limited to the amount actually paid by the client to Webstatic for the service that gave rise to the claim, except where such limitation is not permitted by law.
14. Suspension and termination
We may suspend or refuse delivery/publication in case of non-payment, illegal content, abuse, requests incompatible with the service, lack of cooperation, unclear materials or aggressive, threatening or unreasonable behaviour. Suspension does not automatically cancel amounts owed for work already performed.
15. Governing law
These terms are governed by Romanian law. Disputes will first be approached amicably and, if that is not possible, handled by the competent courts in Romania, according to applicable law.
16. Changes to these terms
We may update these terms periodically to reflect changes to the service, legal requirements or the way we work. The version applicable to a project is the version published or communicated at the time of ordering, unless otherwise agreed in writing.
